HC questions legality of mobile courts
The High Court on Wednesday questioned the legality of running mobile courts by the executive magistrates.
It asked the government to place its explanation for running the mobile court in this manner in four weeks.
The HC bench of Justice Mirza Hussain Haider and Justice Md Anwarul Haque came up with the rule after hearing on a petition challenging the rules of Mobile Court Act 2009 which empowered executive magistrates to practice judicial power through the mobile courts.Kamruzzaman Khan, a real estate businessman who was convicted and sentenced to one-month imprisonment by a mobile court on September 14 for violating the Building Construction Act, filed the petition on October 11.
Khan is now on bail.The HC on Wednesday also suspended Kamruzzaman’s conviction for four months and called for the record of the case against him.
